By using our website, submitting a form, or engaging our services, you agree to these Terms. If you do not agree, do not use our website or services.
1. SERVICESPAVEON provides concrete paving services, including driveways, patios, parking lots, walkways, and related work, primarily in the Des Moines, Iowa area. All quotes and estimates are subject to site inspection and final scope confirmation. Any written estimate we provide is valid for the period stated on the estimate and is subject to material, labor, and scheduling availability.
2. USE OF OUR WEBSITEYou agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the site. You may not attempt to gain unauthorized access to any portion of the site, interfere with its operation, or introduce malicious code.
3. SUBMISSIONS AND REQUESTS FOR QUOTEWhen you submit a form or request a quote, you represent that the information you provide is accurate and that you have the authority to provide it. Submitting a request for quote does not create a contract; a binding agreement requires a written estimate signed or otherwise accepted by both parties.
4. TEXT MESSAGINGWhen you provide your mobile number to PaveOn, L.L.C. and affirmatively opt in, you agree to receive recurring text (SMS/MMS) messages from us relating to your paving project, quotes, appointments, service updates, and occasional promotions. Consent to receive text messages is not a condition of purchasing any goods or services. Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP; reply HELP for assistance. PAVEON is not liable for delayed or undelivered messages. Carriers are not liable for delayed or undelivered messages. Your use of SMS is also governed by our Privacy Policy at paveon.com/privacy-policy.
5. PAYMENTPayment terms for services will be set forth in your written estimate or contract. Unless otherwise specified, invoices are due upon receipt. Late payments may be subject to interest charges and collection costs to the maximum extent permitted by law.
6. INTELLECTUAL PROPERTYAll content on paveon.com — including text, graphics, logos, images, and trademarks — is the property of PaveOn, L.L.C. or its licensors and is protected by intellectual property laws. You may not use, reproduce, or distribute any content from the site without our written permission.
7. DISCLAIMERSOur website and services are provided "as is" without warranties of any kind, either express or implied, except as expressly set forth in a signed written agreement with PAVEON. To the fullest extent permitted by law, PAVEON disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
8. LIMITATION OF LIABILITYTo the fullest extent permitted by law, PaveOn, L.L.C., its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the website or services, even if we have been advised of the possibility of such damages. Our total liability for any claim relating to the website shall not exceed one hundred U.S. dollars ($100.00). This limitation does not apply to the separate terms of any signed service contract.
9. INDEMNIFICATIONYou agree to indemnify and hold harmless PaveOn, L.L.C., its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the website.
10. GOVERNING LAW AND DISPUTE RESOLUTIONThese Terms are governed by the laws of the State of Iowa, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Polk County, Iowa, and you consent to the jurisdiction of those courts.
11. CHANGES TO THESE TERMSWe may update these Terms from time to time. The "Effective Date" at the top indicates the current version. Your continued use of the website after changes are posted constitutes acceptance of the updated Terms.
